Courses marketplace 2.1 Marketplace rules The courses section of our Site is a marketplace (Marketplace) through which we and other users (course creators) may offer educational courses for sale to other users (course purchasers). We may, from time to time, publish rules and policies on our Site relating to the use of the Marketplace, which may include a Content removal policy (Marketplace Rules). You must comply with our Marketplace Rules when accessing or using the Marketplace. We reserve the right, at any time in our sole absolute discretion, to: remove any Content which is illegal, defamatory, obscene, inappropriate, or offensive from the Marketplace without prior notice to you; where you breach the Marketplace Rules or our Terms, withdraw and remove your access to the Marketplace without prior notice; and/or take any action against any user for breaching the Marketplace Rules which we consider appropriate. 2.2 Our role By accessing the Marketplace, you acknowledge and agree as follows: any sale of a course on the Marketplace is a transaction undertaken solely between the course creator and the course purchaser; as a platform provider: we are not a party to any Marketplace transaction (except for courses created by us); and we facilitate each Marketplace transaction solely as the agent of the relevant course creator; and while we will use our reasonable endeavours to assist our users to resolve any disputes, such disputes are between course creators and course purchasers.
Buying a course 3.1 Prices We do not set the prices of any course listed in the Marketplace, except for our own courses which are clearly identified in the course listing. Course prices are determined by the course creators and may be varied at any time by them without notice to you. Unless otherwise expressly stated, all course prices are: payable in US Dollars ($USD); and inclusive of any applicable goods and services tax (GST) and other value-added tax (VAT). 3.2 Acknowledgements By purchasing any course on the Marketplace, you acknowledge and agree as follows: you have read, understood, and agree to our General Terms of Use and these EducationTerms; no course listed on the Marketplace has our endorsement, nor has it been vetted or reviewed by us (whether from a legal or financial perspective, or otherwise) prior to being listed on the Marketplace; subject to law, we make no statements or representations, and give no warranties or guarantees to you, that any course listed on the Marketplace has a value commensurate with the price quoted by the course creator, or that it is suitable for any particular use or purpose; all statements, suggestions, recommendations, and other Content contained in courses listed on the Marketplace, including associated course materials (if any), are provided by the course creator for educational and general information purposes only; and before acting on any course Content, or making any legal, financial, or other decision, you will seek independent legal, accounting, tax, financial, business, technical and other professional advice from appropriately qualified professional advisors.
